The degree of Doctor of Philosophy is available through the Faculty of Law. The standard for the award of the PhD is an original and significant contribution to knowledge - of fact and/or theory. For a doctorate, considerably more original work is required than for a Masters by Research degree. Unless the candidate already has a Master's degree or equivalent research experience, the early stages of a candidate's research towards the PhD degree must be closely supervised to ensure that the candidate has a thorough grounding in research methods. The Faculty also runs a research methods course to this end. In the later stages of the degree, the candidate is allowed increasing scope to pursue his or her research ideas and to demonstrate originality. In the last year of the program, the candidate should be able to work alone and be guided rather than directed by their supervisors.

Students must have completed a undergraduate law degree to an acceptable level to the Faculty Higher Degree Committee (generally honours 1 or equivalent); a postgraduate law degree to an acceptable level to the Faculty Higher Degree Committee (generally a Distinction average is required, plus proof of successful research). In exceptional circumstances, candidates with qualifications in disciplines other than law will be considered. They must also satisfy the following English language requirements: IELTS overall score of 6.5 with a minimum score of 6.0 in each of the sub-tests of speaking, listening, reading and writing; TOEFL - Internet-based Test (iBT) overall score of 90 with a minimum score of 24 in writing; TOEFL - Paper-based Test (PBT) overall score of 577 with a minimum score of 5.0 in the Test of Written English (TWE); successful completion of the UNSW Institute of Languages University English Entry Course with a grade of C+ (grade point 7.0) and a minimum score of 20 in the writing component; overall score of 68 in Pearson Test of English academic version and successful completion of the ANU College Access Program with a minimum of 70 per cent overall.
